These General Terms and Conditions govern the contractual relations and conditions applicable to all purchases made through the www.ruckfield.com merchant site between :

• - NORDIS SARL for e-commerce Ruckfield, whose registered office is at 14-16, RUE DE LA QUARANTAINE, 69005 LYON, France, hereinafter referred to as "NORDIS".
• - any individual or company, acting solely in the capacity of a consumer and strictly for their own personal needs, visiting or making a purchase via the www.ruckfield.com website; hereinafter referred to as "the customer".

The customer declares that he/she has read and understood these terms and conditions.

Placing an order on the www.ruckfield.com website implies the customer's full and unreserved acceptance of these General Terms and Conditions of Sale. All sales made on this site are made exclusively in accordance with these General Terms and Conditions of Sale.

Stipulations or conditions contained in the customer's order which are in any way incompatible with these GTC, or which add to them, will not be binding on NORDIS and will not be applicable, notwithstanding the acceptance of the order by NORDIS. The fact that NORDIS does not object to the stipulations contained in any communication received from the customer shall not be considered as a waiver of these GTC.

These GTC shall prevail over any other general or special conditions not expressly agreed by NORDIS. NORDIS reserves the right to modify its GTC at any time. In this case, the changes will be applicable to sales contracted from the online site of the amended GTC.

Property features

The products offered for sale online are those presented on the www.ruckfield.com website.

The products are described and reproduced by NORDIS on the site as accurately as possible. However, NORDIS draws the customer's attention to the fact that photographs cannot ensure perfect similarity with the product offered for sale, particularly with regard to colors.

Differences may result from the color quality of photographs, the difficulty of rendering materials on the screen or, but not exhaustively, from technical adaptation. Such differences may not be interpreted as defects in conformity and may result in the cancellation of the sale.

NORDIS cannot be held liable for any obvious error or insignificant omission between the characteristics of the product and its representation and/or description. Product offers and prices appearing on the site are valid as long as they appear on the site, within the limits of available stocks.

If a product is unavailable, NORDIS undertakes to inform the customer as soon as possible by e-mail or telephone and to indicate, where appropriate, the estimated waiting time for delivery of the product.

The customer will be able to confirm the order or request a refund on the basis of the invoiced price.

• - Preparation and delivery costs will be refunded if the customer confirms cancellation of the entire order.
• - Preparation and delivery costs will remain payable by the customer if the latter confirms delivery of one or more other available products forming part of the same order.

Promotional offers and "Buy one get one free" duo packs

The "Buy one get one free" offer applies only to products specifically mentioned on the Ruckfield website. This is indicated by the term "PACK DUO".

In the event of return of the purchased product, the item offered must also be returned in its original condition.

Returns management for duo packs :

If the customer returns the item purchased and wishes an exchange or credit note, he/she must also return the item offered.

In the event of non-return of the item offered, the exchange of the item cannot be considered. The return will be refused. 

In the event of non-return of the item offered, the credit note or refund will be made after deduction of the value of the item offered, calculated on the basis of the unit price of the product excluding the promotion.

If the item offered has a defect, the customer may request an exchange subject to the applicable warranty conditions.

Price

The prices of products offered for sale on the www.ruckfield.com website are expressed in euros, including VAT, and are valid only on the website.

Preparation and delivery costs are extra and payable by the customer, unless otherwise stated on the site.

NORDIS reserves the right to modify the price of its products at any time and without prior notice to the customer, in particular in the event of an obvious error (typography or printing) or a change in the VAT rate.

Products ordered are invoiced to the customer on the basis of the price list in force on the site at the time the order is registered.

Control

The creation of a "Ruckfield account" is mandatory to make a purchase on the www.ruckfield.com website.

All stages of the sale are clearly identified on the site in accordance with the provisions of article 1369-1 of the French Civil Code. In application of these provisions, the customer has the opportunity to check the details of his order and its total price, and to correct any errors before finally validating his order.

The order is only definitively registered once the customer has validated his payment agreement and the bank has accepted the transaction.

A printable version of the customer's order summary is available.

As soon as the order is registered, the customer receives a confirmation e-mail containing the essential elements of the order, in particular the order number, the list of products ordered and the detailed price.

All data provided by the customer during the ordering process and the recorded confirmation of this order are proof of the transaction.

NORDIS reserves the right to refuse any order from a customer with whom there is a dispute over payment of a previous order until such dispute is resolved.

Payment

Customers can pay for purchases on the www.ruckfield.com website by credit card.

The following credit cards are accepted: Carte bleue, Visa, Mastercard and Paypal.

When finalizing the order process, the customer is asked to enter their credit card number, the expiry date of their credit card and the last 3 digits of the visual cryptogram on the back of the card.

Cheques are not accepted as payment on the www.ruckfield.com website.

Payment details and the order number appear on the confirmation e-mail sent to the customer.

Measures to combat bank fraud

NORDIS reserves the right to verify the personal data provided by the customer and to adopt any measures it deems necessary (request for proof and/or cancellation of the order) to verify that the person whose bank account is debited is indeed the person who placed the order and thus avoid any fraudulent use of credit card numbers on its site.

Payment security

For each product offered for sale, the customer can pay by credit card by entering his 16-digit card number, its expiry date and the visual cryptogram on the back of his card, depending on the type of card.

The products ordered remain the property of the company NORDIS until full payment of the invoice.

The customer confirms that he/she is authorized to make the payment by credit card. In the case of payment by credit card without authentication, the payment order may be repudiated in the event of fraudulent use of the card, in accordance with the contract concluded between the customer and his/her bank.

NORDIS delegates the use of encryption to BNP Paribas bank to secure transactions in accordance with current legislation. Banking information is transmitted only to the Mollie partner and is 128-bit SSL (Secure Socket Layer) encrypted. NORDIS has no knowledge of the customer's credit card number. The appearance of "https://..." in the address field and of a pictogram at the bottom of the customer's browser are proof accepted by the customer. Each credit card payment is subject to an authorization request to the customer's bank. The latter accepts or refuses the payment transaction.

The Mollie payment interface uses 3D Secure technology. This is a system developed by the Visa and MasterCard credit card networks to authenticate cardholders and prevent fraudulent use of their cards. In addition to the card number, validity date and cryptogram, with the 3D Secure system, cardholders must authenticate themselves on their bank's interface, to which they are automatically redirected, by entering a code or personal information previously transmitted to them by their bank. Once authenticated, the cardholder's transaction will be authorized or refused by his or her bank.

Delivery

The order can be delivered by La Poste in So Colissimo to the delivery address entered by the customer, within an average of 4 working days.

Orders can be delivered by Chronopost to the delivery address entered by the customer, within an average of 2 working days.

The customer is informed of the dispatch of his parcel by e-mail.

Withdrawal

The customer has a right of withdrawal of 14 clear days after receipt of the product.

To do this, the customer must return the new item(s) in their original, undamaged packaging, together with any accessories, instructions and documentation, in accordance with the conditions set out in the RETURNS section, to the following address:

In this case, the customer may obtain a refund or exchange of the product, within a maximum of 30 days of exercising the right of withdrawal.

Returns

The customer has a period of 30 days from receipt of the order to return a product that does not suit him, regardless of the delivery method chosen.

The product must be returned in its original packaging and in perfect condition.

For reasons of hygiene, items such as underwear and socks cannot be returned or exchanged.

All products in the "second line", upcycling category are non-returnable and non-exchangeable.

Products that have been worn, damaged, stained or returned in an obviously abusive manner will not be accepted.

In this case, the parcel will be made available to the customer for 30 days.

The customer may request in writing to NORDIS Customer Service that the parcel be reshipped at the customer's expense.

All risks related to the return of the product are the responsibility of the customer.

The customer may request the return of a product by returning it at his own expense in a sealed parcel with the return slip provided by Customer Service to the following address:

To ensure delivery of the parcel, NORDIS recommends that the customer return the product by Colissimo Suivi (La Poste) with the "Against signature" option.

The customer will be reimbursed on the basis of the price of the invoiced product appearing on the order summary and the preparation and delivery costs actually paid by the customer, within an average of 8 working days, from the date of receipt of the package by NORDIS on the bank account that made the purchase.

Transfer of ownership / Transfer of risk

The transfer of ownership of the products to the customer will only take place after full payment of the price by the latter, regardless of the delivery date of said products.

On the other hand, the transfer of the risks of loss and deterioration of the products will take place upon delivery and receipt of the products by the customer.

Warranty

All products offered for sale on the www.ruckfield.com website are covered by the legal warranty against hidden defects stipulated in articles 1641 et seq. and article 1648 of the French Civil Code.

NORDIS undertakes to refund the customer or exchange any product apparently defective, damaged or damaged within 6 months from the date of receipt or withdrawal of the order by the customer.

In the event of an obvious error attributable to NORDIS, and in particular in the event of non-conformity of the products received with the products ordered (error in size, color, etc.), the customer must contact Customer Service, who will issue a prepaid label for the return (or exchange) of the non-conforming receipt.

• - any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, service interruptions or other unintentional problems;
• - of the content of sites to which hypertext links may lead from its own site.

Intellectual property

All elements of the NORDIS website are and remain the exclusive intellectual property of NORDIS and SAS RUCKFIELD.

The customer is not authorized to reproduce, exploit, distribute, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound.

Copyright

The texts, images, drawings and layout of the site, as well as the graphic charter of this site, are protected by intellectual property law.

It is forbidden to copy, extract, distribute, modify or adapt the content of this site. Downloading and printing of text, images and graphics is permitted for private, non-commercial use only. The reproduction of drawings, images, sound documents, video sequences and texts in other electronic or printed publications requires the prior written consent of NORDIS. Failure to obtain such consent is punishable as an infringement of copyright.

Brands

The brands and logos appearing on the sites are registered and protected trademarks.

Any total or partial reproduction of these brands and/or logos, made from elements of the site without the express authorization of the company NORDIS is constitutive of counterfeit sanctioned by articles L.335-2 and following of the Code of intellectual property.

Databases

Archiving

In accordance with the provisions of Article 1348 of the Civil Code, NORDIS archive purchase orders and invoices on a reliable and durable as a true copy.

In accordance with the provisions of Article 132-4 of the Consumer Code and the decree of February 16, 2005, orders over € 120 are archived and stored by NORDIS for 10 years.

The computerized records of the company NORDIS will be considered by NORDIS and the customer as proof of communications, orders, payments and transactions between NORDIS and the customer.

Disputes

These online terms and conditions are governed by French law.

Any dispute that cannot be settled amicably will be brought before the competent courts of the registered office of the company NORDIS.
